1. About this policy
This policy explains how North South Buyers Agents, the buyers agency of North South Real Estate ("we", "us", "our"), handles personal information collected through northsouthbuyersagents.com.au and our related websites, and in providing our buyers agent services. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and we handle personal information in line with them.
"Personal information" is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not it is true and whether or not it is recorded in a material form.
2. The personal information we collect
The information we collect depends on how you deal with us. It may include:

(b) the details of your enquiry, including the properties you are interested in, your requirements, budget, preferred locations and timing;
(c) information about your finance position and, where relevant to a transaction, your financial circumstances, bank account details and the source of your funds;
(d) identity information such as your date of birth, citizenship, residency or visa status, and copies of identity documents, where we need to verify your identity or where the law requires it;
(e) if you buy, sell, lease or rent property through us, information about the property and the transaction, and information needed to prepare agreements and applications;
(f) information about your business, employer or the entity you represent, if you deal with us on its behalf;
(g) records of our communications with you, including emails, messages, notes of calls and meetings, and survey or feedback responses;

(i) information about your use of our websites, such as your IP address, device and browser type, pages viewed and how you arrived at our site;
(j) any other information you choose to give us or that we need in order to provide our services.
We do not ask for sensitive information (such as health, religious or political information) unless it is necessary and you consent, or the law requires or authorises it.
3. How we collect it
Most information comes directly from you: when you complete a form on our websites, contact us by phone, email or messaging service, book an appointment, attend an inspection or event, or deal with us in the course of a transaction.
We may also collect information about you from others, including:
(a) your representatives, such as your solicitor, conveyancer, accountant, financial adviser or migration agent;
(b) the other parties to a transaction and their representatives;
(c) developers, sellers, other real estate agents and their representatives;

(e) property data and information providers, public registers and other publicly available sources;
(f) identity verification services, and government bodies where the law requires it;
(g) online platforms, social media and review services you use to contact or interact with us.
Where we collect information about you from someone else, we take reasonable steps to make sure you know we hold it and why, unless that would be unreasonable or the law allows otherwise.
You can browse our websites without telling us who you are. If you prefer not to give us information we ask for, we may not be able to answer your enquiry or provide our services.
4. How we use it
We use personal information to:
(a) respond to enquiries and provide our buyers agent services, including searching for, assessing, negotiating and bidding on property for you;
(b) introduce you to properties, developers, sellers and other parties relevant to your requirements;
(c) prepare, manage and keep records of transactions and agreements;

(h) any other purpose you consent to, or that the law requires or permits.
5. Technology, including artificial intelligence
We use software and online services, some of which include artificial intelligence (AI) features, to help manage enquiries, communications, records and marketing. These tools may help us draft, translate, summarise and organise information. Our staff review this work and remain responsible for it. Information an AI tool produces about you, such as a summary or a note, is handled under this policy like any other personal information.
We do not use computer programs, including AI, to make decisions that could reasonably be expected to significantly affect your rights or interests using your personal information. If that changes, we will update this policy first to describe the kinds of decisions and the information used.
6. Who we disclose it to
We disclose personal information only where it is reasonably necessary for the purposes in section 4, or where you consent or the law requires or permits it. Recipients may include:
(a) our staff, and North South Real Estate and the other businesses and brands related to us, which may handle your enquiry or provide related services;

(c) the other parties to a transaction and their representatives, as needed to progress it;
(d) developers, sellers, real estate agents and their representatives, where needed to answer your enquiry or progress a transaction;
(e) professionals you ask us to refer you to, such as finance brokers, solicitors, conveyancers, accountants and migration agents;
(f) our insurers and professional advisers;
(g) government bodies, regulators, courts and law enforcement agencies, where the law requires or authorises it;
(h) a prospective buyer of all or part of our business, under an obligation of confidentiality.
We require our service providers to protect personal information and to use it only to provide their services to us. We do not sell personal information.
7. Disclosure outside Australia
We are likely to disclose personal information outside Australia to service providers that store or process information for us, which may be located in the United States, the United Kingdom, member states of the European Union, Singapore and other countries where those providers operate.
We take reasonable steps to ensure overseas recipients handle personal information consistently with the Australian Privacy Principles, except where you consent otherwise or the law permits it.
8. Direct marketing
We may send you information about properties, services and events by email, SMS, phone, messaging service or post, where you have asked us to, where you would reasonably expect it, or where the law otherwise permits. We comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).
You can opt out at any time by using the unsubscribe option in our messages or by contacting us using the details in section 15. If we obtained your contact details from someone else, you can ask us where we obtained them.
9. Cookies, analytics and online advertising
Our websites use cookies and similar technologies to operate the site, remember your preferences, understand how the site is used and measure the effect of our marketing.
We use Google Analytics, a service provided by Google, to understand how visitors use our websites. It collects information such as your IP address, device and browser type and the pages you view. Google explains how it uses this information at policies.google.com/technologies/partner-sites. You can opt out with the Google Analytics opt-out browser add-on (tools.google.com/dlpage/gaoptout).
We may also use advertising services to show our advertisements to people who have visited our websites, and to measure their results. You can manage personalised advertising in the settings of the platforms concerned.
Some pages include content and links from third parties, such as videos, maps, messaging, booking and form-protection services. When you use them, those providers may collect information and set cookies under their own privacy policies.
You can block or delete cookies in your browser settings. Some parts of our websites may not work properly if you do.
10. How we store and protect it
We hold personal information in electronic and paper records, including with service providers that store information for us. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification and disclosure. These steps include access controls, confidentiality obligations on our staff and service providers, and secure handling of documents.
No method of transmitting or storing information is completely secure. If you have reason to believe your information is no longer secure, please tell us straight away.
11. Data breaches
If a data breach is likely to result in serious harm to the people whose information is involved, we will assess it promptly and notify the affected individuals and the Office of the Australian Information Commissioner, as required by the Notifiable Data Breaches scheme.
12. How long we keep it
We keep personal information only for as long as we need it for the purposes in section 4, including to meet legal, regulatory and record-keeping requirements. Some records must be kept for set periods, for example seven years for certain transaction and identity records. When we no longer need information, we take reasonable steps to destroy it or de-identify it.
13. Accessing and correcting your information
You can ask for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in section 15. We will need to verify your identity before we respond.
We will respond within 30 days. There is no charge for making a request or for a correction. If providing access involves significant cost, we may charge a reasonable fee and will tell you first. If we refuse access or correction, we will tell you why in writing, unless that would be unreasonable, and explain how you can complain.
14. Complaints
If you have a concern about how we have handled your personal information, please contact our Privacy Officer using the details in section 15. We will acknowledge your complaint, look into it, and respond in writing within 30 days.
